Sub-clause (A) of clause (iv) of the first proviso to sub-section (5) of section 80G: This particular provision deals with the eligibility criteria and process for obtaining provisional approval for a charitable institution or fund under Section 80G.


12A Registration:

Terms and Conditions for Seven Sea Welfare Foundation

1. General Overview By donating to or using the services of Seven Sea Welfare Foundation (SSWF), you agree to comply with the following terms. These terms are designed to ensure that the resources of our NGO are used strictly for charitable purposes as mandated by our 12A and 80G registrations. 2. Mandatory PAN Requirement • To comply with the Income Tax Act, every donor seeking tax benefits under Section 80G must provide a valid PAN card at the time of transaction. • Donations without a valid PAN will be treated as anonymous/general contributions and will not be eligible for tax-exempt receipts. 3. Donation Receipt & Slip Generation • Verification: All funds undergo a mandatory bank reconciliation and internal board review. • Timeline: The official donation slip/receipt will be generated up to 30 days after the money is received in our bank account. This buffer is required to verify donor details and project allocation. 4. Refund and Cancellation Policy • Non-Refundable Nature: As a charitable organisation, funds are immediately committed to our social relief projects. Therefore, donations are generally non-refundable. • Internal Board Review: If you believe a donation was made in error, a request must be sent to sevenseawelfarefoundation@gmail.com within 24 hours of the transaction. • Investigation: Our internal team will conduct a problem visit or inquiry. If the team finds no valid or genuine reason, the request will be rejected. • Partial Refund: If a refund is approved by the internal team, a maximum of 1% may be refunded. The remaining 99% is strictly non-refundable to cover non-reversible bank gateway charges, administrative documentation, and committed project overheads. • Post-Receipt Rule: No refund will be considered once an 80G receipt has been generated. 5. Limitation of Liability The foundation is not responsible for any technical failures during the payment process. All disputes are subject to the jurisdiction of courts in North 24 Parganas, West Bengal.

1. Refund & Cancellation Policy

• Internal Board Review: All refund requests are subject to a mandatory review by the Seven Sea Welfare Foundation Internal Management Team. Our team will conduct an inquiry (which may include a problem visit) to verify the reason for the request. • Valid Reason Requirement: If our internal team does not find a valid or genuine reason for the refund, the donation will be considered 100% non-refundable. • Maximum Refund Limit: In the rare event that a refund is approved, a maximum of 1% of the donation amount will be returned. The remaining 99% is strictly non-refundable to cover non-reversible payment gateway charges, bank fees, and administrative costs already incurred for our social projects. • Timeline: Any refund inquiry must be sent to sevenseawelfarefoundation@gmail.com within 24 hours of the transaction. • 80G Clause: No refund will be issued if an 80G tax-exempt receipt has already been generated. ________________________________________

2. Privacy Policy

• Data Collection: We collect donor information including Name, Address, Contact Number, and Mandatory PAN Card details for 80G tax compliance. • Purpose of Data: Your data is used strictly for issuing donation receipts, reporting to the Income Tax Department (Form 10BD), and providing updates on our social projects (Food Distribution, Education, and Shelter). • Security: We use secure payment gateways to process transactions. We do not store your credit card or bank login details on our servers. • Third-Party Disclosure: We do not sell or rent your personal information. Data is only shared with government authorities (Income Tax Department) as required by law for your 80G tax benefits.

3.  Delivery Policy

Note: Since we are an NGO providing social services, this policy clarifies how "deliverables" like receipts are handled. • Donation Slips: As per our internal accounting procedures, official donation slips/receipts are generated up to 30 days after the funds are successfully received in our bank account. • Method of Delivery: Digital receipts will be sent via Email or WhatsApp to the contact details provided at the time of donation. • Physical Goods: For donors who sponsor specific items (like Education Kits or Food Packs), these are delivered directly to the beneficiaries in North 24 Parganas. Donors will receive a digital report of the distribution within 30-45 days. ________________________________________
